Reducing the length of your sick pay sanction

If your employee applies for a WIA benefit and we determine you have not done enough to support their return-to-work process, you might face a sick pay sanction ('loonsanctie'). This means you will have to continue paying your employee's salary for up to 1 year. You might be able to reduce the length of this sanction.

What you need to do to reduce the length of your sanction

You have received a sanction because you did not meet all of the requirements necessary to help your employee return to work. We have sent you a return-to-work evaluation that outlines exactly what you need to do to fulfil each one of these requirements. Once you have met all of these requirements, you can submit a request to reduce the length of your sanction.

How to submit a request to reduce the length of your sanction

Describe in a document what you have done to meet each individual requirement listed in the return-to-work evaluation. Once you have done this, upload the document on the employer portal using your EH3 level eHerkenning account.

Keep in mind that the dismissal ban (‘opzegverbod’) will remain in force for as long as the sanction lasts.

Decision

You will receive a decision about your request within 3 weeks of uploading the document. If we think you have done enough to support your employee’s return-to-work process, you will no longer be required to continue paying their salary.
