Requesting an evaluation of the sickness benefit due to violations

If you are a self-insured employer for the sickness benefit (‘Ziektewet-uitkering’) and you feel your employee or former employee is violating the rules regarding sick leave, you can suspend or reduce their sickness benefit. However, before doing so, you must request an evaluation from us for a fee. You will only be able to impose a penalty on your employee if the outcome of this evaluation confirms they have violated the rules.

What are the criteria for imposing a penalty?

In the following situations, you may impose a penalty on your employee or former employee:

  • if they do not have a valid ID
  • if they make it difficult or impossible for you to monitor their compliance with certain obligations
  • if they do not report sick or do not report sick on time
  • if they miss appointments without having a valid reason for doing so
  • if they obstruct medical examinations by a specialist
  • if they provide false or incomplete information about their income or work situation
  • if they failed to provide information about themselves that could affect their sickness benefit, or if they failed to provide this information on time
  • if they did not seek medical assistance on time or if they deliberately ignored the physician’s advice
  • if they have not made enough effort to find suitable work
  • if they intentionally contributed to their illness or occupational disability, delayed their recovery or interfered with their treatment

How to submit a request for an evaluation

To submit a request for an evaluation, complete the Evaluation form for violations (‘Beoordeling maatregel Ziektewet-uitkering’) and email it to info.erzw@uwv.nl. Alternatively, if you are a Digipoort user, you can submit a request through your own HR administration system, which is directly linked to our system.

What will you need when completing the form?

You will need to provide the date on which your employee or former employee first became ill. Please also have the following details close to hand:

  • your payroll tax number (‘loonheffingennummer’)
  • your self-insured contributions code (‘sector en risicopremiegroep’)
  • your employee or former employee’s name, citizen service number (‘BSN’) and date of birth
  • your employee or former employee’s average daily income (‘dagloon’)
  • any relevant information and documents we might need to evaluate your request

Cost

The current cost of this service is 39 euros.

Decision

You can expect to receive the outcome of our evaluation within 4 weeks of submitting your request. You will also receive a letter from us with information on how to pay for it.
